Mercury33 Marketing LLC, a Wyoming limited liability company, is the sole owner of this Website and the sole data controller (and, where applicable, business) responsible for the processing described here. This Policy does not apply to any other company, brand, or website.

If you engage us for marketing, AI, automation, or related professional services, the contract, statement of work, and any data processing addendum between you and Mercury33 Marketing LLC will govern that engagement. This Website Policy covers the Website and ordinary business inquiries, not every processing activity we may perform as a service provider on a client’s behalf.

2. Information we collect

We collect information in the following ways:

Information you provide

When you email us, call us, or otherwise contact us, we receive the information you choose to share. That typically includes:

  • Name, company, job title, and professional role
  • Email address, telephone number, and mailing or business address
  • The content of your message and any files you send
  • Any other details you include so we can respond or evaluate a potential engagement

Information collected automatically

When you visit the Website, our hosting provider and standard web infrastructure may automatically collect:

  • IP address, approximate location derived from IP, browser type, device type, and operating system
  • Pages viewed, referring URL, date and time of the visit, and similar diagnostic logs
  • Cookie identifiers and similar technologies, as described in Section 6

Information from service providers

We may receive limited information from vendors that help us operate the Website and our business (for example, hosting, email, and telecommunications providers), such as delivery or bounce status for emails we send you.

3. How we use information

We use personal information to:

  • Operate, maintain, and improve the Website
  • Respond to inquiries and communicate about our services
  • Evaluate, negotiate, and perform contracts with clients and vendors
  • Send business communications you request or that are reasonably related to an existing relationship
  • Protect the security and integrity of our systems, prevent fraud or abuse, and enforce our Terms & Conditions
  • Comply with law, respond to lawful requests, and establish or defend legal claims
  • Keep records required for accounting, tax, and corporate compliance

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

4. Legal bases (EEA / UK visitors)

If you are in the European Economic Area or the United Kingdom, we process personal information only when we have a legal basis, including:

  • Legitimate interests: operating a business website, answering professional inquiries, and securing our systems, where those interests are not overridden by your rights
  • Contract: taking steps at your request before entering a contract, or performing a contract with you
  • Legal obligation: keeping records or disclosing information where the law requires it
  • Consent: where we ask for it, for example certain optional cookies or marketing emails. You may withdraw consent at any time without affecting prior processing

5. How we share information

We share personal information only as needed to run our business, including with:

  • Service providers that host the Website, provide email, telecommunications, accounting, or IT support, under contracts that require them to protect the information
  • Professional advisors such as lawyers, accountants, and insurers
  • Authorities when we believe disclosure is required by law, court order, or to protect rights, safety, or property
  • Business transfers if we are involved in a merger, acquisition, financing, or sale of assets, subject to appropriate confidentiality

We do not share Website inquiry data with unaffiliated companies for their own independent marketing. Mercury33 Marketing LLC is the only Mercury33 entity that determines the purposes of this processing.

6. Cookies and similar technologies

The Website may use cookies, local storage, or similar technologies that are strictly necessary to deliver the site, remember basic preferences, or provide security. Our hosting or content-delivery infrastructure may also set technical cookies.

If we use analytics or similar measurement tools, they collect usage data (such as pages viewed and approximate location) to understand how the Website is used. You can control cookies through your browser settings. Blocking some cookies may affect how the Website functions.

For interest-based advertising opt-outs offered by industry programs, you may visit aboutads.info (US) or youronlinechoices.eu (EU), where those programs apply. We currently do not operate advertising pixels on this Website for the purpose of selling personal information.

7. Retention

We keep personal information only as long as needed for the purposes described in this Policy, including to provide services, maintain business records, resolve disputes, and meet legal, tax, and accounting requirements. Inquiry emails and related correspondence are typically retained for the life of the business relationship and for a reasonable period afterward. Server logs are retained for a shorter operational period unless needed for security or legal reasons.

8. Security

We use administrative, technical, and organizational measures designed to protect personal information against unauthorized access, loss, or misuse. No method of transmission or storage is completely secure. Please use a current browser and contact us immediately if you believe your communication with us has been compromised.

9. International transfers

Mercury33 Marketing LLC is established in the United States. If you contact us from outside the United States, your information will be processed in the United States and may be processed in other countries where our service providers operate. Those countries may have data-protection laws different from the laws of your country. Where required, we use appropriate safeguards for such transfers, such as standard contractual clauses.

10. Your rights

Depending on where you live, you may have the right to request access, correction, deletion, or a copy of your personal information; to object to or restrict certain processing; to withdraw consent; and to lodge a complaint with a supervisory authority.

If you are a California resident, you may also have rights under the California Consumer Privacy Act (as amended by the CPRA), including the right to know, delete, and correct personal information, and to not be discriminated against for exercising those rights. We do not sell or share personal information as those terms are defined under California law.

To exercise a privacy right, email lets-talk@mercury33.com with the subject line “Privacy Request.” We may need to verify your identity before fulfilling the request. You may use an authorized agent where the law allows it, subject to verification.

12. Third-party sites

The Website may link to third-party websites. We are not responsible for their content or privacy practices. Review their policies before providing them information.

13. Changes

We may update this Policy from time to time. The “Last updated” date at the top of this page will change when we do. The current version is always published at https://mercury33.com/privacy. Continued use of the Website after an update means you acknowledge the revised Policy.
